RENTAL CONTRACT AGREEMENT |
Blue & Gray Brewing Company, a Virginia Corporation, hereinafter referred to as “Lessor” leases to the customer, hereinafter referred to “Lessee”, the equipment, property, or machines listed above, hereinafter referred to as the “Rental Property”, subject to the terms and conditions as follows:
TERMS NOW, Therefore, the parties do hereby agree one with the other as follows:
1. That the term of this Lease shall be for a period of ___ day(s) commencing ________________ , 2006 and ending ________________ , 2006. Additional days' fee will be $10 a day, deductible from security deposit. There is a twelve hour grace period beyond “due back” time before another days fee will be assessed.
RENTAL
That the consideration of this Lease shall be the sum of_________________ dollars, plus $_______ delivery. Upon execution of this Lease, the responsible party shall pay the sum of $250.00 Two Hundred and fifty Dollars, which shall constitute the security deposit for the specific periods within the term of the Lease. The Lessee's is liable for loss of or damage to the rental property in all circumstances. Any damage, loss, theft or other incident that leads to the units' inoperability will be deducted from this security deposit. In the event of total loss or theft the lessee will be responsible for the full replacement cost of each unit of six-hundred and fifty, ($650.00) dollars. Lessee acknowledges receipt of the described rental property. The parties agree that the property was inspected by Lessor and personally examined by Lessee at the time of delivery or pickup and that the property was in good and serviceable condition. Title to the rental property is, and at all times shall remain in Lessors's name. |
Parties agree that Lessor is not the manufacturer of said property nor the agent of the manufacturer and that no warranty against patent or latent defects in material, workmanship or capacity is given. |
Rental property will be reserved for the Lessee upon receipt of a deposit for $50.00 and signed reservation. The Lessor has a 30 day cancellation policy whereby the deposit on any canceled rental property becomes non-refundable should you cancel the reservation within 30 days of the scheduled delivery or pickup date.

Lessee agrees that in the event any rental property becomes unsafe or in a state of disrepair, Lessee will immediately discontinue the use thereof and promptly return it to the Lessor. Upon receiving such property, if its condition is not the fault of the Lessee, Lessor agrees to replace such property of like kind and in good working condition. Lessor shall not be liable in any event to Lessee for any loss, delay or damage, expense and penalty arising from defects in or efficiency of the rental property or accidental breakage thereof. |
Upon termination of this agreement, Lessee will promptly return the rental property and all attachments and parts belonging thereto, to the Lessor at Lessor's place of business and during regular business hours (as noted on front of this document), in the same condition in which such property was received, ordinary wear and tear excepted, and agrees to pay for any damages caused to or loss of such property. Lessee also agrees to pay Lessor's reasonable attorney fees and court costs.
If Lessor attempts to deliver rental property per agreed schedule and is prevented from doing so due to the fault of Lessee, Lessee agrees to pay an additional fee for re-delivery equal to the amount of the original delivery fee on this contract. Lessee further understands that re-delivery will be scheduled at a time convenient for Lessor. Lessee agrees to pay additional charges for the following services: a) Delivery or pickup from any location other than ground level and truck accessible; b) Items for pick up which are not in the same place to which they were delivered; c) Set up and take down: d) Delivery and pickup before or after normal business hours; and e) Dirty rental property. Lessee agrees to indemnify and save harmless the Lessor against all loss, damage, expense and penalty arising from any action on account of any injury to person or property of any character occasioned by the operation, handling or transportation of the rental property during the rental period or while the property is in the possession of control of Lessee. Lessee will give Lessor immediate notice of any levy attempted upon said property, or if said property from any cause becomes liable to seizure, and to indemnify Lessor against all loss and damages caused by any such action, including Lessor's reasonable attorney's fees and expenses.
Lessee will not retain the rental property beyond the “Date In” time without prior written notice to and the consent of Lessor thereto. Lessee will pay rental price in advance or immediately upon the return of rental property. Lessee agrees to pay all collection charges including reasonable attorney's fees, if the rental is not paid when due. Lessor, at Lessor's sole discretion may report rental property stolen if held (5) days beyond “Date In” date. Lessor, at Lessor's sole discretion, may revert all charges to the daily rate if any monthly statement or invoice is not properly paid. Lessor will not refund on any item out over (30) minutes. Lessor will extend credit for like amount on any item providing Lessee uses this credit within a period of (15) days from the “Date Out” of Contract. Lessee acknowledges that Lessee and any employee of Lessee who will be using the rental property are familiar with the operation and use of the rental property and have had an opportunity to ask questions of and receive instructions from Lessor concerning the proper use and operation of the equipment. Lessee hereby waives and releases Lessor from all claims for injuries or damages to Lessee arising out of the use of said rental property by Lessee.
Lessee will not permit the rental property to be used or operated in violation of any Federal, State or Municipal statute, law, ordinance, rule or regulation and will indemnify, defend and hold Lessor harmless from all fines and/or penalties incurred from the violation of any statute, law, ordinance, rule or regulation of any duly constituted public authority. Should any provision of this Contract be held to be invalid or unenforceable, the remainder of the provisions shall not be affected but be given full effect without regard to the invalid or unenforceable portions.
This document shall constitute the entire contract between Lessor and Lessee. Additional Terms:____________________________________________________________________
